Register products in New York

Learn about the registration process for products in New York.

Which product types to register

In New York, you will need to register:

  • Beer
  • Low ABV wine (done as a No COLA registration)
  • Cider
  • Spirits
  • Non-malt beverages (such as seltzer or kombucha)

You will need to include the following information for each product you register:

  • Alcohol by Volume (ABV)
  • Size

How to register your products

You must register all alcoholic beverages for all product types sold in the state of New York as a new brand label. A brand label is made up of the following four components:

  • Brand or trade name
  • Class and type of the alcoholic beverage
  • Net contents of the container
  • Any other labeling information required by the TTB (for example, alcohol content or flavor description,)

The following exceptions do not constitute a new brand label:

  • Cordial and liqueur brand label names, if the only difference is the flavor description
  • Wine brand label names, if the only difference is vintage year
  • Gin brand label names, if the only difference is the addition of the designation dry
  • Rum brand label names, if the only difference is the addition of the designation white, light, dark, gold or silver
  • Changes to ABV do not need to be registered as a revision for beer, wine, or cider products
  • Size additions (additional container sizes) do not need to be registered

State fees and approval time

New York registrations are valid for three years. Fees are prorated by the year you register your product. Renewals are effective for the full 3-year period, and therefore cost the maximum amount.

In addition to the state fee, you will also pay a $10 technology charge.

Fees paid using ACH take around five business days to clear. After this, the state will be able to view your registration, and approve or deny the application.

Small batch exemption

Liquor, beer, and cider produced in small batches are exempt from the brand label registration fee. Small batches mean:

  • For liquor, 1000 gallons or less per year
  • For beer and cider, 1500 barrels or less per year

The fee exemption applies to products under the same state brand label registration. The total annual amount of product manufactured includes not only the amount of product manufactured for sale in New York, but the entire annual amount of the product that is manufactured, regardless of where it will be sold. If the total annual amount of product that you have manufactured exceeds (or is anticipated to exceed) the amount listed here, you will need to pay the state fee.

If your annual production volume exceeds the Small Batch amounts, you will indicate it under Product Details. Check the box next to Exceeds Annual Brand Label Production Volume. Checking this box will mean your registration is subject to the state fee.

License information

New York state licenses are seven digits. Do not include dashes (-) when entering your license number.

Distributor information

Distributor information is not required as part of brand label registration in New York.

Required documents

  • Brand Authorization Letter, if you are not the brand owner
  • Lab Analysis Document, if you are registering a non-malt beverage

Renewals

Registration coverage periods (these periods repeat every three years):

  • Beer: 7/1/2021 - 6/30/2024
  • Spirits: 10/1/2022 - 9/30/2025
  • Low ABV Wine and Cider: 3/1/2023 - 2/28/2026

The renewal portal in New York is open the last month of each registration's effective period.

Per state law, New York withholds 25% of state fees if a registration is denied. The full technology fee ($10) and 75% of the state fee is refunded to the original payment method (refunds may take 3-5 business days).

In New York, retailers should register their brand labels as private registrations. These brands may only be sold at the retailer's licensed premises. In PRO, when selecting the type of registration you're submitting for New York, select This is a private registration.
